Overview

SummerSagaMods (download.summersagamods.com) respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. We respond promptly to valid notices of alleged copyright infringement.

If you believe that content hosted on or linked to from this site infringes a copyright you own or control, you may submit a written DMCA takedown notice to our designated agent using the contact details below. We will review the notice and, where appropriate, remove or disable access to the claimed material.

Submitting a false DMCA notice is a violation of federal law. Before filing, ensure your claim is made in good faith and that you are authorized to act on behalf of the copyright owner.

Filing a Takedown Notice

To submit a DMCA takedown request, send a written notice to our designated copyright agent at the email address listed in the Contact section below. Your notice must include all of the required elements described in the next section to be actionable.

We will acknowledge valid notices within 5 business days and take appropriate action, which may include removing the identified content, disabling links, or contacting the uploader to obtain authorization evidence.

Please send requests only for content you genuinely own or control. Notices submitted on behalf of a third party must include written authorization from the rights holder confirming that you are permitted to act as their agent.

Notice Requirements

Under 17 U.S.C. § 512(c)(3), a valid DMCA takedown notice must include all of the following:

  1. A physical or electronic signature of the person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed. If multiple works are covered by a single notice, a representative list of those works.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material (e.g., the full URL of the page where the content appears).
  4. Information reasonably sufficient to permit us to contact you as the complaining party: your name, address, telephone number, and email address.
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Notices that are materially incomplete may not be acted upon. We recommend reviewing the DMCA statutory requirements before submitting.

Counter-Notice Procedure

If you believe content was removed or disabled as a result of a mistake or misidentification, you may file a counter-notice under 17 U.S.C. § 512(g). A valid counter-notice must include:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled.
  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who submitted the original takedown notice or their agent.

Upon receiving a valid counter-notice, we will forward it to the original complainant. If the complainant does not notify us within 10 to 14 business days that they have filed a court action, we may restore the removed material at our discretion.

Repeat Infringer Policy

In accordance with the DMCA and other applicable law, SummerSagaMods maintains a policy of terminating, in appropriate circumstances, the accounts or access of users who are deemed to be repeat infringers. We reserve the right to make this determination at our sole discretion based on the volume, nature, and outcome of takedown notices received.
